When you book any trekking or adventure activity with Indiantreks, you enter into a contract between Indian Treks (‘First Party’) and you (‘Second Party’). This agreement also applies to anyone for whom you book services. By proceeding with the booking, you acknowledge that you have read, understood, and agreed to the following terms and conditions.

Trekking, climbing, and mountaineering in the Himalayas come with inherent risks to both life and property. The weather can change suddenly, leading to challenging conditions, potential injuries, or even life-threatening situations—many of which are beyond our control. At Indiantreks, we prioritize safety and take every possible measure to minimize risks, discomfort, and hazards. However, despite our best efforts, unforeseen accidents, mishaps, or service disruptions may still occur.

By booking with us, you acknowledge and accept these risks. We strongly advise you to read and understand these terms carefully before confirming your booking.

1)Promotions

Pictures used in collateral and on the website are intended for marketing purposes. These do not suggest that the visual material will be a part of your vacation or that you will see, experience, or encounter anything that is seen in the pictures.

2) Fitness Responsibility

Indiantreks offers a range of treks and trips that demand different levels of physical fitness and effort. A number of variables, including temperatures, weather, altitude, and terrain, can make some trips physically taxing. You must carefully consider each trek’s difficulty level before making a reservation to make sure it fits with your abilities and to allow for enough preparation.

Medical and Health-Related Considerations
There is no medical authority on Indiantreks. Before starting on an expedition, it is your responsibility to see your physician and make sure you are well enough, including having received the required vaccinations. Should you be unable to manage the physical demands of a trip, we will not be held responsible. Prior training is not necessary for many of our tours, but it will improve your experience if you are reasonably fit.

Participant Responsibilities
You solely are in responsible for:
Ensuring your mental and physical readiness for the trek.
Bringing the necessary gear and clothes for the trek.
Disclosing any medical conditions, disabilities, pregnancy, or mental health concerns that could affect your participation. any condition that might endanger

Participation is open to all ages, but your safety or the safety of others must be disclosed at the time of booking. If you don’t, you risk being kicked off the trek right away and facing any associated cancellation fees.

3)Important Notice: Program Dates

Regarding our trekking and adventure programs, we at Indiantreks work hard to provide accurate and current information. Reviewing and verifying the accuracy of all the dates mentioned on your travel documents, however, is entirely your responsibility.

Dates of the trek’s beginning and conclusion
Reporting time and place
Time of departure and any further plans
Please notify our team right away of any inconsistencies to prevent last-minute inconveniences.

4)Required Documents

All necessary paperwork has to be sent in ahead of time to guarantee a hassle-free and easy trekking journey. Any delays or interruptions brought on by unfinished trip procedures or the absence of necessary paperwork before to departure are not Indiantreks‘ responsible.

5) Itinerary 

At Indianteks, enjoyment and safety come first. We are dedicated to providing an honest, dedicated, and perfect trekking experience. However due to adventure travel is unpredictable, Indiantreks has the right, in the event of unforeseen circumstances, to modify or cancel any portion of the itinerary.

These might consist of, but are not restricted to:
Natural disasters (high snowfall, landslides, etc.)
Transportation delays or road closures
Government limitations or political upheaval
Delays or cancellations of flights
Accidents, illnesses, or emergencies

The participant is responsible for paying any additional costs that result from these adjustments, and they must be paid immediately. We will try our best to notify you of any changes either before or during the trek so that your journey is as unhindered as possible.

6)Refund Policy:

If you voluntarily depart or withdraw from a trip for any reason after it has started, you will not be eligible for a full or partial refund. Accommodations, transportation, sightseeing, meals, and services that are not used will not be refunded.

We shall provide a substitute trip or date in the event that Indiantreks cancels a trip because of unanticipated circumstances. You will be informed of this change, and you may decide whether to accept the substitute trip, get a one-year voucher, or go on another trip of your choosing. Any discrepancies in price will be your responsibility. Indiantreks will not be responsible for any additional fees, commissions, credit card charges, or other travel-related arrangements, such as hotels, trains, flights, visa fees, or further travel plans. In this instance, refunds will adhere to our cancellation policy.
Situations such as voluntary or forced tour termination due to illness, family emergencies, late arrival, or other personal reasons are not eligible for refunds. 

7)Communication Policy: 

The participant’s contact details from the registration form will be used for all correspondence, including emails, phone calls, and WhatsApp messages. Any communication loss or delay brought on by inaccurate or missing contact information is not Indiantreks’ responsibility.

8)Responsibility for Luggage

You are responsible for the safety of your personal belongings and luggage throughout your trip. While the journey, you are entirely in charge of your own belongings. No matter what the reason, Indiantreks is not liable for the loss of your luggage, goods, tickets for flights, passport, cash, checks for travelers, or any other thing you own while on trek / trip.

9) On-trip Behaviour:

You are required to behave in a manner that is acceptable and conducive to group travel. Indiantreks reserves the right to terminate your trip (if you are found to be causing distress/annoyance to co-travellers, or endanger/damage the property of any supplier or other travelling companions), without assigning any reason whatsoever. No refund for unused services is possible in such cases. You also agree to abide by the authority of the group leader designated by Indiantreks. The decision of the tour leader is binding on all participants on matters that affect the safety or well-being of any person participating in the trip. Behaviour that causes danger, distress or annoyance to others, or interferes with the mobility of the group can result in the group leader terminating your participation in the trip, with no right to refund for missed or unused services.

10) The amenities

At Indiantreks, we put your comfort first while providing a genuine trekking experience in the Himalayas. Please remember, too, that amenities in the mountains might not be the same as those you are used to back home. In remote regions, there is little infrastructure, and inclement weather can occasionally make travel more difficult.

We make an effort to offer necessary amenities, such as:
Clean and comfortable accommodation in campsites, guesthouses, or homestays
Healthy, freshly made meals that are appropriate for walking at high elevations
Clean drinking water and heated liquids
Basic medical care and support for first aid
Skilled tour leaders and support professionals to guarantee your comfort and safety

11) Extra Expenses

Accommodations, food, transportation to and from the airport, guides, admission fees, equipment, and luggage handling as outlined in the itinerary are all included in the various trip inclusions. Unless specified differently, the following expenses are not covered: insurance, domestic and international travel, passport and visa fees, departure taxes, excess baggage fees, tips for drivers, guides, and camp staff, and personal expenditures like laundry, phone calls, and optional excursions

12) Awareness

You accept that active adventure travel requires a certain amount of personal risk by its very nature. You are likely to travel to places where specific risks, dangers and physical difficulties are brought on by political, cultural, and geographic characteristics. By booking a trip with Indiantreks, you acknowledge that you understand the risks, hazards, and difficulties that come with personal travel and that you take responsibility for such risks. By signing this agreement, you accept all associated risks and absolve Indiantreks of all liability for any losses, injuries, or fatalities brought on by these inherent dangers. You are responsible for acquainting yourself with local embassy contacts in each destination, as well as customs, weather, physical obstacles, and applicable legislation.

13) In Case of Emergency

If you fall ill or experience an accident during the trip, all medical expenses, including hospital bills, doctor fees, evacuation costs (by road or air), repatriation, and any other related charges, will be your responsibility. We strongly recommend having a comprehensive travel insurance policy that covers such emergencies.

14) Third-Party Services

To ensure the seamless execution of our operations, Indiantreks engages third-party service providers who are experts in their respective fields. While we carefully select these providers, you acknowledge and accept that Indiantreks is not liable—directly or indirectly—for any shortcomings, delays, or issues arising from their services.

Additionally, Indiantreks bears no responsibility for any loss, damage, or harm to your luggage, personal belongings, or person when transported by porters, ponies, vehicles, or any other means during the trip. This also applies during your arrival, departure, and stay at any hotel, guest house, or other accommodation arranged as part of the itinerary.

15) Photography & Media Rights

By booking or participating in a trip with Indiantreks, you grant us a royalty-free, perpetual, worldwide, and irrevocable license to capture and use your photographs and videos for promotional purposes. This includes, but is not limited to, marketing materials, websites, social media, brochures, and other publicity content. Additionally, any photos or videos shared by you with Indiantreks via email, WhatsApp, or website links may also be used for promotional purposes.

Please note that Indiantreks does not require prior consent or provide compensation for the use of such images or videos. However, we respect your privacy. If you prefer not to have your images used, please inform us at the time of booking. Special considerations are available for media professionals upon request.

16) Optional Activities Disclaimer

Optional activities are not included as part of the trip or this contract. Any assistance provided by Indiantreks, its partners, or representatives does not create any liability for Indiantreks. Your contract for such activities will be directly with the respective activity provider. By participating in these activities, you acknowledge and agree to release Indiantreks from all claims, liabilities, and causes of action that may arise. Indiantreks acts solely as a travel organizer and does not own, operate, or control airlines, hotels, restaurants, tourist attractions, transportation services, or any other facilities mentioned in our itineraries.

We take all reasonable steps to ensure that trip arrangements meet required standards. Our service providers are carefully selected, and we strive to provide accurate service descriptions. However, as we do not manage or operate these providers, Indiantreks cannot be held liable for any injury, damage, loss, accident, delay, or irregularity arising—directly or indirectly—due to the actions or shortcomings of third-party suppliers. Where applicable, the terms and conditions of these suppliers will be clearly stated.

By accessing and using the official Indiantreks website, you acknowledge and agree to abide by our Terms and Conditions and Privacy Policy, which govern your relationship with the company and this website.

17) Definitions

“Indiantreks,” “us,” or “we” are terms used to refer to the company and its directors.
“You” refers about the website’s user or visitor.
Indiantreks has the right, without previous notice or explanation, to alter any agreements pertaining to the trip.
We reserve the right to cancel any trip at any time and for any reason. Indiantreks may also add, change, or modify any of these terms and conditions, replace any trip in whole or in part, or cancel it entirely. In the event of a dispute, Indiantreks’ decision will be final and binding on both parties. According to Indian law, you have the fundamental right to arbitrate disputes and file lawsuits

18) Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Both Indiantreks and you irrevocably consent to the exclusive jurisdiction of the courts of India for resolving any disputes arising in connection with these Terms.

19) Dispute Resolution

If you encounter any issues or challenges during your trek, please notify the relevant personnel immediately. Inform your Trek Leader or contact our Operations Team directly so we can address your concerns promptly and take necessary remedial action.

The company is not liable for the non-performance of an itinerary due to circumstances beyond its control or if we are not informed of a problem in a timely manner when corrective measures could have been taken. In the unlikely event that a complaint cannot be resolved during the trek, any disputes arising from this agreement shall be governed by Indian law. Both parties agree to submit to the jurisdiction of the courts in Dehradun, Uttarakhand.
